Service

1. Who you are agreeing with

These terms govern your use of the UNSEEN mobile app, operated by [OPERATOR LEGAL NAME], [POSTAL ADDRESS], reachable at [CONTACT EMAIL]. By creating an account you accept them. If you do not accept them, do not create an account.

How we handle your data is described separately in our Privacy Policy.

2. Your account

• You must be at least 16 years old.
• You choose your role — Explorer or Business — when you sign up. It cannot be changed afterwards; a different role means a new account.
• You are responsible for what happens under your account, and for keeping your password to yourself.
• One person, one account. Do not create accounts to get around a block, a removal or a ban.
• You can delete your account at any time from your profile in the app.

3. Content you post

You keep ownership of the photos and text you post. By posting them, you grant us a non-exclusive, worldwide, royalty-free licence to store them and display them inside the app, for as long as you keep them posted. Delete a photo, or your account, and that licence ends — we stop displaying it.

You confirm, for everything you post, that:

• you took it, or you have the right to post it;
• it does not infringe anyone's copyright, trade mark or other rights;
• it actually relates to the place or event you are posting it to.

4. Photographing other people

Photos here are taken in bars, on streets and at events, where other people are present. That does not make them fair game.

• Do not photograph people who have not agreed to it.
• Do not post a photo in which someone else is identifiable without their consent.
• Never post photos of children who are not your own.
• If someone asks you to take a photo of them down, take it down.

Anyone who appears in a photo without having agreed to it can report it in the app — open the photo and choose "Shows me or someone else without consent" — or write to [CONTACT EMAIL]. We remove such photos on request, and the person asking does not have to justify it.

5. Objectionable content — zero tolerance

There is no tolerance for objectionable content or abusive behaviour on UNSEEN. You may not post, and may not use the app to distribute:

• sexual content, nudity or any sexualised depiction of minors;
• violence, gore, or the glorification of either;
• hate speech, harassment, threats, or attacks on people for who they are;
• content that depicts or promotes illegal activity;
• spam, scams, advertising for third parties, or deliberately misleading content;
• photos of people posted without their consent (see section 4);
• anything that impersonates another person or business.

How this is enforced

• Every photo in the app can be reported, by anyone, from the photo itself.
• Once two different people report the same photo, it is hidden automatically while we review it.
• Reports reach us by email and are reviewed. We remove content that breaks these rules.
• You can block any user. Their photos disappear from your view immediately.
• Accounts that post prohibited content are removed. For serious cases this happens without warning and permanently.

6. Additional rules for Business accounts

A Business account exists to list your own venue. Business accounts are not verified by us, which makes these rules the thing that has to hold:

• Only list places you actually operate or are authorised to represent. Listing someone else's venue is impersonation and gets the account removed.
• You must hold the rights to every photo you upload for a place or event.
• Names, addresses, opening hours and event times must be accurate, and you must keep them up to date.
• Do not create duplicate listings for the same venue, and do not create listings to manipulate rankings.
• Events must be real events at that venue.

If you believe someone has listed your venue, tell us at [CONTACT EMAIL] or report the place in the app. We will take it down.

Deleting a Business account deactivates its places and events. They stop appearing in Discover and Hotspots, but remain in the collections of users who saved them, marked as no longer maintained.

7. Using the app itself

You may not:

• access the service by automated means, scrape it, or bulk-extract its content;
• attempt to reach data that is not yours — in particular other users' swipe history, private photos or exact positions;
• interfere with or overload the service;
• bypass the location check that gates posting a photo at a venue.

8. What the service is, and is not

UNSEEN shows places and events listed by third parties and photos posted by users. We do not check them beforehand, and we do not warrant that any of it is accurate, current or safe. Opening hours are as good as what the business entered. Whether a place is worth going to, and whether going there is safe, is your call.

The service is provided as it is. We do not guarantee it will be available without interruption or free of errors.

9. Liability

We are liable without limitation for intent and gross negligence, and for injury to life, body or health. For ordinary negligence we are liable only where an obligation essential to the purpose of this agreement has been breached, and then only for the damage typically foreseeable for such an agreement. Liability under the German Product Liability Act is unaffected.

10. Ending this agreement

You can delete your account at any time in the app. We may suspend or delete an account that breaks these terms; for serious breaches, immediately. Where we can, we will tell you why.

11. Changes

We may update these terms. If we do, you will be asked to accept the new version in the app before continuing to use it. The version and date at the top identify the current text.

12. Applicable law

German law applies, excluding its conflict-of-law rules. If you are a consumer with your habitual residence in another EU member state, the mandatory consumer protections of that state still apply to you.
